Booking and tour terms and conditions for the FOSS MARAI SPUMANTI VALDOBBIADENE S.r.l. winery
Taken together with the Privacy Policy regarding bookings, these Terms and Conditions govern bookings and tours of the FOSS MARAI SPUMANTI VALDOBBIADENE S.r.l. winery, specifying both the obligations of the winery to visitors and the obligations that visitors agree to upon booking a tour, including the accompanying tasting. These Terms and Conditions are subject to Italian law.
Henceforth, the words “you”, “your” and “yours” shall mean all the people indicated in the booking by name (including those added or replaced after the initial booking). “We”, “us”, “our” and “ours” refer to FOSS MARAI SPUMANTI VALDOBBIADENE S.r.l.
1. Eligibility requirements
Visits to the winery are governed by a few rules:
- Visitors must be of legal age - our tastings are exclusively available to adults (18 years old or older), and an ID must be shown upon entry;
- Pregnant women and guests who don’t drink alcohol - participation is allowed at a discounted price; we will provide non-alcoholic alternatives, however this preference must be indicated when booking;
- Visitors 17 and under - the tour is free for minors from 0 to 17 years of age, but they must be accompanied by at least one adult (18 years or older). Please note that minors can take part in the tour if accompanied by an adult, but not in the tasting;
- Educational trips or large groups (over 20 people) - contact our customer service office (experience@fossmarai.it);
- Available languages for the tour - Italian and English;
- What to wear - we recommend comfortable, closed-toe shoes and a light jacket for the drop in temperature going from outdoors to indoors.
If you have any special requests, please state them upon booking. Although we will do everything possible to accommodate your requests, provided they are reasonable, we cannot guarantee that every request will be fulfilled unless we provide written confirmation. Should you or another visitor have health problems or a disability that could impact the tour, please let us know before your reservation is confirmed. If we reasonably conclude that we cannot meet the specific needs you have indicated, we reserve the right not to confirm your booking or, should that information be omitted at the time of booking, we reserve the right not to take them into consideration.
2. Your booking
The person who makes the booking will be considered the contact person for your group and thus confirms that they are authorised, including on behalf of the other participants, to agree to the Terms and Conditions herein. The group contact person is also ultimately responsible for the payment owed to us.
Your booking is subject to availability and will be confirmed via an email confirmation at the email address you provide. Please read your booking confirmation carefully and contact us if any information is missing or incorrect.
To confirm your reservation, you will be asked to provide credit card information, and the balance for the service will be charged when we send the booking confirmation. If a valid credit card is not provided, we reserve the right not to confirm the booking or to cancel existing bookings should the payment not go through.
3. Obligations
Online reservations for visits shall be completed on our website, following the procedures outlined there.
Your contractual obligations take effect once the booking confirmation is sent to you, as stated herein. This includes the obligation to pay. In that regard, you will be charged for the entire amount due when we confirm your booking, and the relative tax document will be issued.
When you fill in the booking form, and in any case before we send the booking confirmation, you will be able to verify the total cost of the cellar visit.
All communication regarding payments will take place via a special line protected by an encryption system. In addition, we guarantee the storage of payment data with an additional layer of encryption, and in compliance with current regulations governing the protection of personal data.
4. Changes/Cancellations
If you need to change or cancel your booking, you must notify us by email at experience@fossmarai.it, or call us at +39 0423 900560.
Our goal is to provide you with the best possible assistance; however, we cannot guarantee that we will be able to satisfy all requests. Please note that no changes will be made with less than 48 hours advance notice, calculated from the date and hour selected for your cellar tour.
Moreover, please note that, if the conditions are met to change your booking, that change will be treated as a cancellation of the original booking and a subsequent re-booking. For that reason, you will be refunded the original amount paid, and then you will be charged the amount due for the new booking. These transactions will be completed via the payment method used for the initial transaction, unless otherwise agreed upon.
Should you cancel your visit beyond the stated term, that is, less than 48 hours before the visit, you will be charged a cancellation penalty equal to 100% of the amount. No refunds will be issued should you fail to show up for your visit or if you show up more than 10 minutes after the agreed upon tour time.
If we are unable to organize the tour due to circumstances beyond our control, we will promptly notify you and refund the full amount. No other forms of compensation and/or indemnity may be requested.
5. Code of conduct during the tour
The tour will be held in a group with other visitors and it will last 1.5-2 hours. Participants must follow the instructions of the staff and must behave respectfully.
Touching the equipment, machinery and containers used to produce our wine is strictly prohibited. Some parts of the cellar may not be accessible.
We will not be held liable for any injuries that may occur if the rules established by the tour guide, which are necessary to ensure the health and safety of all visitors, are not followed.
Animals are not allowed in the tasting room or any of the work spaces; they are allowed, however, in the outdoor areas as long as they are kept on a leash held by an adult.
When booking, you accept responsibility for any damages or loss caused by you or the participants of your group. Full and immediate payment will be required for all damages or losses caused. If you fail to do so, you will be liable for the legal case brought against you, if any, and you will also be required to pay our legal fees in full, as well as any legal fees incurred by third parties involved.
Last but not least, the provision of alcoholic beverages to minors under the age of 18 is strictly prohibited.
